AGB - General Terms and Conditions (Status 01.03.2023)

Our services are carried out according to §49, paragraph 4 PBefG.
(transportation of persons by passenger cars rented only as a whole for transportation and with which the entrepreneur carries out journeys, the purpose, destination and course of which are determined by the renter).

These GTC apply to all legal transactions of the company SDM-Shuttledienst Mahlow, owner Christoph Ebert. They are part of each contract with their respective contractual partner (hereinafter referred to as customer). The customer declares to have read and understood these terms and conditions when placing the order. He recognizes these irrevocably.

1. scope and content of passenger transportation by SDM-Shuttledienst Mahlow

The passenger transportation contract with the company SDM-Shuttledienst Mahlow, owner Christoph Ebert, Ernst-Thälmann-Straße 47, 15831 Blankenfelde-Mahlow (hereinafter referred to as SDM) is concluded by the commissioning and order confirmation, which can be made by telephone, by mail, by SMS or in person. The scope and price depend on the service agreed therein. In principle, there is no right to transportation by SDM. The published price list contains only prices for orientation, it includes the carriage of luggage in the form of a suitcase and one hand luggage per person. Luggage exceeding this amount must be declared at the time of booking, otherwise SDM may refuse to transport the excess luggage. The carriage of children under 12 years of age must always be included in the booking request due to special security obligations. The carriage of animals must also be indicated at the time of booking and agreed upon individually. The carriage of animals can be refused by SDM if agreements and conditions, which SDM has agreed with the customer, are not adhered to.

Excluded from transportation in any case are goods that fall under the Ordinance on Dangerous Goods, weapons, other goods that pose a danger by their nature or are illegal. SDM has in principle the right to refuse the transport of certain goods.

We reserve the right to charge for special cleaning should the vehicles become soiled, e.g. as a result of nausea or improper use, or exclude the transport of persons who are obviously unfit for transport.

SDM undertakes to comply in principle with the pick-up times agreed with the customer with a small grace period. However, longer waiting times of the customer may occur due to unforeseeable events or exceptional situations for which SDM is not responsible, such as accidents, official inspections, traffic jams or very bad weather conditions with their consequences in the flowing traffic. In this case, waiting times caused by this are to be accepted by the customer.

2. ticket price and payment

The pre-agreed fare must be paid by the customer to the driver at the end of the journey in cash, by EC card or major credit card. If costs such as parking fees are incurred due to waiting times during pick-up, these must also be paid in full by the customer together with the fare.

If payment after invoicing is agreed with the customer, the invoice amount shall be due for payment within 14 calendar days after receipt of the invoice. This shall be deemed to have been agreed upon with confirmation of the order by the customer.

For larger order volumes, SDM may agree with the customer on advance payments, which will be designated in the order confirmation.

3. pick up the customer for trips to the airport or train station.

SDM is based on the pick-up time requested by the customer. The customer is obliged to estimate the pick-up time so that he arrives at the airport or train station in time before departure or departure. For this purpose, the length of the travel time including possible delays due to unforeseeable events in city traffic must be taken into account by him. The customer is responsible for arriving at the airport or train station on time. In case of misjudgement by the customer, there is no claim for damages against SDM.

4. pick up from the airport or train stations in Berlin.

If departure or departure times and thus expected serious delays (+30 minutes), changed arrival points or other changes in the flight or train schedule, SDM must be informed immediately by telephone. In this case, there is no longer any entitlement to transportation. However, we can usually find a solution.

5. Trips abroad

In the case of trips abroad, the customer bears all additional costs for parking, road tolls, accommodation costs for the driver, entrance fees, ferry costs.

6. Vehicle breakdown

In case of any kind of breakdown of our vehicle, which makes it impossible to keep the agreed journey, SDM will try to help the customer to find another transport. In this case, however, there is no right to transportation. Costs arising from this substitute transportation are to be borne by the customer. In such cases, there is no claim for damages against SDM. Any advance payments made will be refunded to the customer in full in this case.

7. Cancellation or rebooking, legal right of withdrawal

For city trips in Berlin (incl. BER and train stations) applies:

Both contracting parties are entitled to a right of withdrawal in accordance with the statutory provisions. Cancellation or rebooking of the transport order by the customer must be made in good time - but at least 12 hours before the agreed pick-up time - by telephone, SMS or e-mail. If SDM incurs costs due to a rebooking or cancellation of the transport order not made in time, these are to be borne by the customer in the full amount of the agreed or expected transport fee. In case of non-arrival at the agreed pick-up date, the customer must pay the full amount of the agreed or expected transportation fee. Calculation basis of the expected transportation fee is the cab tariff of the district of Teltow Fläming valid at the time, plus 10%.

For long distance and hourly bookings applies:

A right of withdrawal is entitled to both contracting parties in accordance with the statutory provisions. Cancellation or rebooking of the transport order by the customer must be made in writing by mail or by post. The date of receipt by SDM is decisive for the calculation of the compensation. Cancellation fees will be calculated less any advance payment made as follows:

- 7 to 5 days before the departure date: 25 % of the total amount
- 4 to 2 days before the departure date: 50 % of the total amount
- 1 to 0 days before the departure date: 100 % of the total amount

In case of non-arrival at the agreed pick-up date, the customer must pay the agreed transportation fee in full.

8. Representation

SDM is not obliged to provide the service personally. In particular, in the event of short-term prevention, vacation and overlapping appointments, SDM may also use other drivers and companies to provide the service.

9. Cut-off time

Mutual claims and rights must be asserted in writing by registered mail or e-mail to the contractual partner no later than 3 months after they have arisen. Otherwise these are forfeited.

10. Severability clause

If one of the above provisions or parts of the provisions of these GTC is invalid, becomes invalid or incomplete, this shall not affect the validity of the remaining provisions. The statutory provisions shall then take their place.
